Welcome to PublisherCraft. These Terms and Conditions (“Terms”) govern your use of our website (publishercraft.com), booking of our services, and the purchase of our books and courses. By engaging with our services, you agree to be bound by these Terms.
1. Services & Scope of Work
PublisherCraft provides a comprehensive publishing ecosystem, including but not limited to:
Writing & Editing: Book titles, outlines, ghostwriting, editing, and blurb writing.
Design: Cover design and book interior formatting.
Consulting: Self-publishing guidance and book promotion strategies.
Technical: Author website setup (WordPress/Wix).
Each project will be governed by a specific Statement of Work (SOW) or email agreement defining the deliverables, timelines, and revision limits.
2. Payments & Escrow Policy
To ensure mutual security for high-value projects, our payment structure is as follows:
Standard Projects: Payments are processed via our website’s integrated payment gateways.
Projects over $500: Use of Escrow.com is mandatory. The Client shall deposit the full project fee into Escrow. Funds will be released according to agreed-upon milestones and their completion.
Escrow Fees: Unless otherwise agreed (splitting the costs), Escrow.com transaction fees are the responsibility of the Client.
3. Intellectual Property (IP) Rights
Ownership Transfer: Upon receipt of full payment, all rights, titles, and interests in the final deliverables (manuscripts, cover designs, etc.) transfer entirely to the Client.
Ghostwriting: PublisherCraft waives all moral rights to ghostwritten content upon final payment. The Client retains 100% of royalties and copyright.
Portfolio Rights: PublisherCraft reserves the right to display project snippets or covers in our “Featured Works” or portfolio section for promotional purposes (anonymously), unless a non-disclosure agreement (NDA) states otherwise.
4. Client Responsibilities
The Client is responsible for:
Providing accurate information and timely feedback.
Ensuring they have the legal right to any images or text provided to PublisherCraft for inclusion in the project.
5. Third-Party Platforms
PublisherCraft assists with the setup and guidance for platforms such as Amazon KDP, Lulu, and IngramSpark. However, we are not responsible for:
Changes in third-party platform terms or pricing.
Account suspensions or book rejections caused by the Client’s account history or content nature.
6. Professional Guarantees & Liability
No Guarantee of Success: While we use market-focused strategies to help you reach “Bestseller” status, PublisherCraft does not guarantee specific sales figures, rankings, or commercial success.
Limitation of Liability: To the maximum extent permitted by law, PublisherCraft’s total liability for any claim arising out of our services shall not exceed the total amount paid by the Client for that specific service.
7. Confidentiality & Non-Disclosure
We respect the sensitive nature of unpublished manuscripts. All files and communications shared with PublisherCraft are treated as strictly confidential and will not be shared with third parties without express written consent.
8. Digital Products & Courses
License to Use: When you purchase a course or digital book from PublisherCraft, we grant you a single, non-exclusive, non-transferable license to access the content for personal, educational use.
Prohibited Actions: You may not record, duplicate, redistribute, or resell any course materials or digital files. Unauthorized sharing of login credentials for course platforms is strictly prohibited and may result in account termination without a refund.
Access Period: Unless otherwise stated, “Lifetime Access” refers to the lifetime of the course as long as it remains hosted on PublisherCraft’s selected platform.
9. Physical & Digital Book Sales
Pricing & Availability: All prices for books are subject to change without notice. We reserve the right to discontinue any title at any time.
Shipping (Physical Books): For physical copies sold directly via the site (or through Lulu/Amazon integrations), shipping times are estimates. PublisherCraft is not responsible for delays caused by the carrier or customs.
Taxes: You are responsible for any sales tax, VAT, or import duties applicable in your jurisdiction.
10. Affiliate Disclosure
Third-Party Links: PublisherCraft contains affiliate links (e.g., to hosting providers, tools, or Amazon). If you click on an affiliate link and make a purchase, we may receive a small commission at no extra cost to you.
Independent Advice: Our recommendations are based on professional experience, but we are not responsible for the performance or terms of any third-party products purchased through these links.
11. Intellectual Property (PublisherCraft Content)
While project deliverables belong to the Client (as per Section 3), all Course Content, Blog Posts, and Books authored by PublisherCraft remain the sole intellectual property of PublisherCraft. No ownership of this content is transferred upon purchase.
12. Termination
Either party may terminate a project if the other party breaches these Terms. In the event of termination by the Client, PublisherCraft shall be compensated for all work completed up to the termination date.
13. Governing Law
These Terms are governed by the laws of Bangladesh, without regard to conflict of law principles. Any disputes shall be resolved through amicable negotiation or, failing that, in the courts of Dhaka, Bangladesh.
